Article 696-43 of the French Code of Criminal Procedure

The investigating chamber which has ruled on the extradition request shall decide whether or not to transmit, in whole or in part, the securities, valuables, money or other objects seized to the requesting government.

Such surrender may take place, even if extradition cannot take place, as a result of the escape or death of the person claimed.

The Investigating Chamber shall order the return of the papers and other objects listed above which do not relate to the act imputed to the person claimed. It shall rule, where applicable, on the claims of third-party holders and other entitled parties.

La chambre de l’instruction qui a statué sur la demande d’extradition décide s’il y a lieu ou non de transmettre, en tout ou en partie, les titres, valeurs, argent ou autres objets saisis au gouvernement requérant.

Cette remise peut avoir lieu, même si l’extradition ne peut s’accomplir, par suite de l’évasion ou de la mort de l’individu réclamé.

La chambre de l’instruction ordonne la restitution des papiers et autres objets énumérés ci-dessus qui ne se rapportent pas au fait imputé à la personne réclamée. Elle statue, le cas échéant, sur les réclamations des tiers détenteurs et autres ayants droit.
