Article 701 of the French Code of Criminal Procedure

In wartime, crimes and offences against the fundamental interests of the Nation and related offences are investigated and tried by the armed forces courts as set out in the code of military justice.

However, the Public Prosecutor shall have the authority to perform or cause to be performed acts required by the urgency and to request for this purpose the investigating judge at his seat. The provisions of articles 698-1 to 698-5 then apply.

He must relinquish jurisdiction or request that the examining magistrate relinquish jurisdiction as soon as the urgency has ceased.

Article 701

En temps de guerre, les crimes et délits contre les intérêts fondamentaux de la Nation et les infractions qui leur sont connexes sont instruits et jugés par les juridictions des forces armées ainsi qu’il est dit au code de justice militaire.

Toutefois, le procureur de la République a qualité pour accomplir ou faire accomplir les actes nécessités par l’urgence et requérir à cet effet le juge d’instruction de son siège. Les dispositions des articles 698-1 à 698-5 sont alors applicables.

Il doit se dessaisir ou requérir le dessaisissement du juge d’instruction dès que l’urgence a cessé.
