Article 704-1 of the French Code of Criminal Procedure

For the prosecution, investigation and, in the case of misdemeanours, trial of the offences provided for in Article 704 and related offences, the public prosecutor, the investigating judge and the specialised criminal court of the judicial tribunal referred to in the same article have concurrent jurisdiction with that resulting from the application of articles 43,52,382and 706-42.

Where they have jurisdiction to prosecute and investigate offences falling within the scope of Article 704, the public prosecutor and the investigating judge shall exercise their powers throughout the area of jurisdiction determined pursuant to Article 704.

The court seised shall retain jurisdiction regardless of the charges retained when the case is settled or judged, subject to the application of the provisions of Articles 181 and 469. If the acts constitute a contravention, the investigating judge orders the case to be referred to the competent police court pursuant to article 522.

Pour la poursuite, l’instruction et, s’il s’agit de délits, le jugement des infractions prévues à l’article 704 et des infractions connexes, le procureur de la République, le juge d’instruction et la formation correctionnelle spécialisée du tribunal judiciaire visé au même article exercent une compétence concurrente à celle qui résulte de l’application des articles 43,52,382 et 706-42.

Lorsqu’ils sont compétents pour la poursuite et l’instruction des infractions entrant dans le champ d’application de l’article 704, le procureur de la République et le juge d’instruction exercent leurs attributions sur toute l’étendue du ressort fixé en application de l’article 704.

La juridiction saisie reste compétente quelles que soient les incriminations retenues lors du règlement ou du jugement de l’affaire sous réserve de l’application des dispositions des articles 181 et 469. Si les faits constituent une contravention, le juge d’instruction prononce le renvoi de l’affaire devant le tribunal de police compétent en application de l’article 522.
