Article 706-107 of the French Code of Criminal Procedure

For investigating, prosecuting, investigating and, in the case of misdemeanours, judging offences relating to the pollution of marine waters and waterways open to maritime navigation as provided for and punished by Chapter VIII of Title I of Book II of the code de l’environnement, which are committed in territorial waters, inland waters and navigable waterways, the jurisdiction of a judicial court may be extended to the jurisdiction of one or more courts of appeal.

The provisions of the first paragraph shall also apply where the offences referred to in that paragraph are committed in the exclusive economic zone or in the ecological protection zone and on the continental shelf.

This jurisdiction extends to related offences.

A decree shall determine the list and jurisdiction of these maritime coastal courts, which shall comprise a section of the public prosecutor’s office and investigating and trial panels specialised in dealing with these offences.

Article 706-107

Pour l’enquête, la poursuite, l’instruction et, s’il s’agit de délits, le jugement des infractions en matière de pollution des eaux marines et des voies ouvertes à la navigation maritime prévues et réprimées par le chapitre VIII du titre Ier du livre II du code de l’environnement, qui sont commises dans les eaux territoriales, les eaux intérieures et les voies navigables, la compétence d’un tribunal judiciaire peut être étendue au ressort d’une ou plusieurs cours d’appel.

Les dispositions du premier alinéa s’appliquent également lorsque les infractions mentionnées dans cet alinéa sont commises dans la zone économique exclusive ou dans la zone de protection écologique et sur le plateau continental.

Cette compétence s’étend aux infractions connexes.

Un décret fixe la liste et le ressort de ces juridictions du littoral maritime, qui comprennent une section du parquet et des formations d’instruction et de jugement spécialisées pour connaître de ces infractions.
