Article 706-112-2 of the French Code of Criminal Procedure

When the evidence gathered in the course of proceedings concerning a crime or offence punishable by imprisonment reveals that a person who must be heard freely pursuant to article 61-1 is the subject of a legal protection measure, the officer or agent of the judicial police shall notify the curator or guardian by any means, who may appoint a lawyer or request that a lawyer be appointed by the President of the Bar to assist the person at the hearing. If it has not been possible to notify the guardian or curator and if the person heard has not been assisted by a lawyer, the statements made by this person may not be used as the sole basis for his conviction.

Lorsque les éléments recueillis au cours d’une procédure concernant un crime ou un délit puni d’une peine d’emprisonnement font apparaître qu’une personne devant être entendue librement en application de l’article 61-1 fait l’objet d’une mesure de protection juridique, l’officier ou l’agent de police judiciaire en avise par tout moyen le curateur ou le tuteur, qui peut désigner un avocat ou demander qu’un avocat soit désigné par le bâtonnier pour assister la personne lors de son audition. Si le tuteur ou le curateur n’a pu être avisé et si la personne entendue n’a pas été assistée par un avocat, les déclarations de cette personne ne peuvent servir de seul fondement à sa condamnation.
