Without prejudice to the application of articles 706-112-1 to 706-112-3, when the person is being prosecuted, the public prosecutor or investigating judge notifies the curator or guardian and the guardianship judge. The same applies if the person is the subject of an alternative to prosecution consisting of reparation of the damage or mediation, a penal composition or an appearance on prior recognition of guilt or if he is heard as an assisted witness.
The curator or guardian may inspect the documents in the proceedings under the same conditions as those laid down for the person being prosecuted.
If the person is remanded in custody, the curator or guardian is entitled to a visiting permit as of right.
The public prosecutor or investigating judge shall notify the curator or guardian of decisions to dismiss the case, acquit, acquit of criminal irresponsibility on account of mental disorder, or convict the person.
The curator or guardian is notified of the hearing date. Where he is present at the hearing, he is heard by the court as a witness.
