Article 706-139-2 of the French Code of Criminal Procedure

Where, pursuant to Article 351 of this Code, the question of the application of the first paragraph of Article 122-1 of the Criminal Code in relation to an accused charged with murder, assassination, torture or acts of barbarism, violence or rape, the President asked the subsidiary question relating to the qualifications provided for in Articles 221-5-6,222-18-4or 222-26-2 of the same code if it appears that the abolition of the person’s discernment or control over their actions is likely to result from the voluntary consumption of psychoactive substances.

Lorsque, en application de l’article 351 du présent code, est posée devant la cour d’assises la question de l’application du premier alinéa de l’article 122-1 du code pénal à l’égard d’un accusé mis en accusation pour meurtre, assassinat, tortures ou actes de barbarie, violences ou viol, le président pose la question subsidiaire portant sur les qualifications prévues aux articles 221-5-6,222-18-4 ou 222-26-2 du même code s’il apparaît que l’abolition du discernement de la personne ou du contrôle de ses actes est susceptible de résulter d’une consommation volontaire de substances psychoactives.
