Article 706-167 of the French Code of Criminal Procedure

The procedure applicable to the investigation, prosecution, trial and judgment of the following crimes and misdemeanours and related offences shall be that provided for by this Code, subject to the provisions of this Title:

1° Offences relating to nuclear materials and weapons and property related to nuclear materials provided for by 1° and 2° of I of Article L. 1333-9 and articles L. 1333-11, L. 1333-13-1 à L. 1333-13-6 and L. 1333-14 of the Defence Code;

2° Offences relating to biological or toxin-based weapons provided for by articles L. 2341-1, L. 2341-2, L. 2341-4 and L. 2341-5 of the same code;

3° Offences relating to chemical weapons and products provided for by articles L. 2342-57 à L. 2342-61 of the same code;

4° Offences relating to the proliferation of delivery systems for weapons of mass destruction as provided for in articles L. 2339-14 à L. 2339-16 of the same code;

5° The offences of smuggling, importing or exporting provided for in the second and last paragraphs of Article 414 of the Customs Code, when they involve dual-use goods, both civil and military;

6° The offences of supplying information to a foreign power provided for by Articles 411-6 to 411-8 of the Penal Code when these offences are related to one of the offences mentioned in 1° to 5° of this article;

7° The offence of participation in a criminal association provided for by Article 450-1 of the Criminal Codewhen its purpose is to prepare one of the aforementioned offences.

This Title shall also apply to the prosecution, investigation and trial of the aforementioned offences committed abroad where French law is applicable by virtue of Section 2 of Chapter III of Title I of Book I of the Criminal Code.

Article 706-167

La procédure applicable à l’enquête, à la poursuite, à l’instruction et au jugement des crimes et des délits suivants ainsi que des infractions connexes est celle prévue par le présent code, sous réserve des dispositions du présent titre :

1° Les infractions relatives aux matières et aux armes nucléaires et aux biens connexes aux matières nucléaires prévues par les 1° et 2° du I de l’article L. 1333-9 et les articles L. 1333-11, L. 1333-13-1 à L. 1333-13-6 et L. 1333-14 du code de la défense ;

2° Les infractions relatives aux armes biologiques ou à base de toxines prévues par les articles L. 2341-1, L. 2341-2, L. 2341-4 et L. 2341-5 du même code ;

3° Les infractions relatives aux armes et produits chimiques prévues par les articles L. 2342-57 à L. 2342-61 du même code ;

4° Les infractions relatives à la prolifération des vecteurs d’armes de destruction massive prévues par les articles L. 2339-14 à L. 2339-16 du même code ;

5° Les délits de contrebande, d’importation ou d’exportation prévus aux deuxième et dernier alinéas de l’article 414 du code des douanes, lorsqu’ils portent sur des biens à double usage, civil et militaire ;

6° Les infractions de livraison d’informations à une puissance étrangère prévues par les articles 411-6 à 411-8 du code pénal lorsque ces infractions sont en relation avec l’une des infractions mentionnées aux 1° à 5° du présent article ;

7° Le délit de participation à une association de malfaiteurs prévu par l’article 450-1 du code pénal lorsqu’il a pour objet de préparer l’une des infractions susvisées.

Le présent titre est également applicable à la poursuite, à l’instruction et au jugement des infractions susvisées commises à l’étranger lorsque la loi française est applicable en vertu de la section 2 du chapitre III du titre Ier du livre Ier du code pénal.
