Article 706-169 of the French Code of Criminal Procedure

The public prosecutor at a judicial court other than that of Paris may, for offences falling within the scope of Article 706-167, request the investigating judge to relinquish jurisdiction in favour of the Paris investigating court. The parties shall be notified in advance and invited to make their observations by the investigating judge; the order shall be made eight days at the earliest and one month at the latest from such notification.

The order by which the examining magistrate relinquishes jurisdiction does not take effect until the five-day period provided for in Article 706-173 has elapsed; where an appeal is lodged pursuant to that Article, the examining magistrate remains seised until the judgment of the Criminal Division of the Court of Cassation is brought to his attention.

As soon as the order has become final, the public prosecutor sends the case file to the anti-terrorist public prosecutor.

This article is applicable before the Investigating Chamber.

Le procureur de la République près un tribunal judiciaire autre que celui de Paris peut, pour les infractions entrant dans le champ d’application de l’article 706-167, requérir le juge d’instruction de se dessaisir au profit de la juridiction d’instruction de Paris. Les parties sont préalablement avisées et invitées à faire connaître leurs observations par le juge d’instruction ; l’ordonnance est rendue huit jours au plus tôt et un mois au plus tard à compter de cet avis.

L’ordonnance par laquelle le juge d’instruction se dessaisit ne prend effet qu’à compter du délai de cinq jours prévu par l’article 706-173 ; lorsqu’un recours est exercé en application de cet article, le juge d’instruction demeure saisi jusqu’à ce que l’arrêt de la chambre criminelle de la Cour de cassation soit porté à sa connaissance.

Dès que l’ordonnance est devenue définitive, le procureur de la République adresse le dossier de la procédure au procureur de la République antiterroriste.

Le présent article est applicable devant la chambre de l’instruction.
