Where it appears to the Paris examining magistrate that the acts referred to him do not constitute one of the offences falling within the scope of Article 706-167 and do not fall within its jurisdiction in any other respect, this magistrate shall declare himself incompetent either at the request of the Anti-Terrorism Public Prosecutor or, after receiving the latter’s opinion, of his own motion or at the request of the parties. The parties who have not submitted an application shall be notified in advance and invited to make their observations known; the order shall be made at the earliest eight days after this notification.
The second paragraph of Article 706-169 is applicable to the order by which the Paris investigating judge declares that he has no jurisdiction.
As soon as the order has become final, the anti-terrorist public prosecutor sends the case file to the public prosecutor with territorial jurisdiction.
This article is applicable when the investigating chamber of the Paris court of appeal rules on its jurisdiction.
