The public prosecutor at a judicial court other than those mentioned in Article 706-176 may, for offences falling within the scope of the same Article 706-176, request the investigating judge to relinquish jurisdiction in favour of the competent investigating court pursuant to the said Article. The parties are notified in advance and invited to make their observations by the investigating judge. The order is made eight days at the earliest and one month at the latest from this notification.
When the examining magistrate decides to relinquish jurisdiction, his order only takes effect from the five-day period provided for in Article 706-180; when an appeal is lodged pursuant to this article, the examining magistrate remains seised until he is notified of the judgment of the Investigating Chamber that has become res judicata or that of the Criminal Division of the Court of Cassation.
As soon as the order has become res judicata, the public prosecutor sends the case file to the public prosecutor at the judicial court with jurisdiction pursuant to Article 706-178.
