Article 706-37 of the French Code of Criminal Procedure

The Public Prosecutor shall notify the owner of the building, the lessor and the owner of the land where an establishment is operated in which the facts referred to in 2° of article 225-10 of the Penal Code and shall have the initiation of proceedings and the decision taken recorded in the commercial register and in the registers in which the securities are recorded. The procedures for applying this article shall be determined by decree in the Conseil d’Etat.

Article 706-37

Le ministère public fait connaître au propriétaire de l’immeuble, au bailleur et au propriétaire du fonds où est exploité un établissement dans lequel sont constatés les faits visés au 2° de l’article 225-10 du code pénal et fait mentionner au registre du commerce et aux registres sur lesquels sont inscrites les sûretés l’engagement des poursuites et la décision intervenue. Les modalités d’application du présent article sont déterminées par décret en Conseil d’Etat.
