Article 706-65 of the French Code of Criminal Procedure

When the judge intends to request the opinion of the Cour de cassation pursuant to article L. 151-1 du code de l’organisation judiciaire, it notifies the parties and the public prosecutor. It shall receive any written observations from the parties and the conclusions of the public prosecutor within the time limit it shall set, unless these observations or conclusions have already been communicated.

On receipt of the observations and submissions or on expiry of the time limit, the judge may, in a decision that is not subject to appeal, request the opinion of the Cour de cassation by formulating the question of law that he is submitting to it. It shall stay its decision until it has received the opinion or until the expiry of the period referred to in Article 706-67.

Lorsque le juge envisage de solliciter l’avis de la Cour de cassation en application de l’article L. 151-1 du code de l’organisation judiciaire, il en avise les parties et le ministère public. Il recueille les observations écrites éventuelles des parties et les conclusions du ministère public dans le délai qu’il fixe, à moins que ces observations ou conclusions n’aient déjà été communiquées.

Dès réception des observations et conclusions ou à l’expiration du délai, le juge peut, par une décision non susceptible de recours, solliciter l’avis de la Cour de cassation en formulant la question de droit qu’il lui soumet. Il surseoit à statuer jusqu’à la réception de l’avis ou jusqu’à l’expiration du délai mentionné à l’article 706-67.
