The public prosecutor at a judicial court other than that of Paris may, for offences falling within the scope of Article 706-72, request the investigating judge to relinquish jurisdiction in favour of the Paris investigating court. The parties are notified in advance and invited to make their observations by the examining magistrate; the order is made eight days, at the earliest, and one month, at the latest, from this notification.
The order by which the Examining Magistrate relinquishes jurisdiction does not take effect until five days have elapsed; where an appeal is lodged pursuant to Article 706-72, the Examining Magistrate remains seised until he is notified of the ruling of the Criminal Division of the Court of Cassation.
As soon as the order has become final, the Public Prosecutor sends the case file to the Paris Public Prosecutor.
This Article shall apply before the Examining Magistrates’ Chamber.
