Article 753 of the French Code of civil procedure

Where representation by a lawyer is not compulsory, the summons shall contain, on pain of nullity, in addition to the particulars prescribed in articles 54 and 56, the surname, first names and address of the person with whom the claimant elects domicile in France when residing abroad.

Where applicable, the summons shall mention the claimant’s agreement to the proceedings being conducted without a hearing pursuant to the Article L. 212-5-1 of the Code of Judicial Organisation.

The document instituting proceedings also refers to the provisions of article 832 and mentions the conditions under which the defendant may be assisted or represented, as well as, if applicable, the name of the plaintiff’s representative.

Lorsque la représentation par avocat n’est pas obligatoire, l’assignation contient, à peine de nullité, outre les mentions prescrites aux articles 54 et 56, les nom, prénoms et adresse de la personne chez qui le demandeur élit domicile en France lorsqu’il réside à l’étranger.


Le cas échéant, l’assignation mentionne l’accord du demandeur pour que la procédure se déroule sans audience en application de l’article L. 212-5-1 du code de l’organisation judiciaire.


L’acte introductif d’instance rappelle en outre les dispositions de l’article 832 et mentionne les conditions dans lesquelles le défendeur peut se faire assister ou représenter, ainsi que, s’il y a lieu, le nom du représentant du demandeur.
