Article 757 of the French Code of civil procedure

In addition to the information prescribed by articles 54 and 57, the application must contain, on pain of nullity, a summary statement of the grounds for the application. The documents that the claimant wishes to invoke in support of his claims shall be attached to his application in as many copies as there are persons whose summons is requested.

Where applicable, the application shall mention the applicant’s agreement to the proceedings being conducted without a hearing pursuant to Article L. 212-5-1 of the Code of Judicial Organisation.

When the application is filed electronically, the documents are attached in a single copy.

Where each party is represented by a lawyer, the application shall contain, on pain of nullity, the constitution of the lawyer or lawyers of the parties. It shall be signed by the lawyers appointed.

It shall be deemed to constitute a statement of claim.

Outre les mentions prescrites par les articles 54 et 57, la requête doit contenir, à peine de nullité, un exposé sommaire des motifs de la demande. Les pièces que le requérant souhaite invoquer à l’appui de ses prétentions sont jointes à sa requête en autant de copies que de personnes dont la convocation est demandée.


Le cas échéant, la requête mentionne l’accord du requérant pour que la procédure se déroule sans audience en application de l’article L. 212-5-1 du code de l’organisation judiciaire.


Lorsque la requête est formée par voie électronique, les pièces sont jointes en un seul exemplaire.


Lorsque chaque partie est représentée par un avocat, la requête contient, à peine de nullité, la constitution de l’avocat ou des avocats des parties. Elle est signée par les avocats constitués.


Elle vaut conclusions.
