Article 759 of the French Civil Code

Any usufruct belonging to the spouse on the property of the predeceased, whether resulting from the law, a will or a gift of future property, gives rise to an option to convert it into a life annuity, at the request of one of the bare owner heirs or of the successor spouse himself.

Tout usufruit appartenant au conjoint sur les biens du prédécédé, qu’il résulte de la loi, d’un testament ou d’une donation de biens à venir, donne ouverture à une faculté de conversion en rente viagère, à la demande de l’un des héritiers nus-propriétaires ou du conjoint successible lui-même.
