Article 764 of the French Code of civil procedure

As soon as it is constituted, the defendant’s lawyer informs the plaintiff’s lawyer; a copy of the act of constitution is given to the court registry.

The document includes, where applicable, the defendant’s agreement for the proceedings to proceed without a hearing pursuant to article L. 212-5-1 du code de l’organisation judiciaire.

Dès qu’il est constitué, l’avocat du défendeur en informe celui du demandeur ; copie de l’acte de constitution est remise au greffe.


L’acte comporte, le cas échéant, l’accord du défendeur pour que la procédure se déroule sans audience en application de l’article L. 212-5-1 du code de l’organisation judiciaire.
