Article 792 of the French Civil Code

The creditors of the estate declare their claims by notifying their title to the elected domicile of the estate. They are paid under the conditions provided for in Article 796. Claims whose amount has not yet been definitively determined are declared provisionally on the basis of an assessment.

Failure to declare within fifteen months of the publication provided for in Article 788, unsecured claims on the estate’s assets are extinguished with regard to the estate. This provision also applies to guarantors and co-obligors, as well as to persons who have given an independent guarantee in respect of the claim thus extinguished.

Article 792

Les créanciers de la succession déclarent leurs créances en notifiant leur titre au domicile élu de la succession. Ils sont payés dans les conditions prévues à l’article 796. Les créances dont le montant n’est pas encore définitivement fixé sont déclarées à titre provisionnel sur la base d’une évaluation.

Faute de déclaration dans un délai de quinze mois à compter de la publicité prévue à l’article 788, les créances non assorties de sûretés sur les biens de la succession sont éteintes à l’égard de celle-ci. Cette disposition bénéficie également aux cautions et coobligés, ainsi qu’aux personnes ayant consenti une garantie autonome portant sur la créance ainsi éteinte.
