Article 80-2 of the French Code of Criminal Procedure

The examining magistrate may inform a person by registered letter that he or she has been summoned, within a period of not less than ten days and not more than two months, to appear for the first time in accordance with the conditions laid down in article 116. The letter shall state the date and time of the summons. It informs the person of each of the acts referred to the magistrate and for which an indictment is envisaged, specifying their legal classification. It informs the person that he or she has the right to choose a lawyer or to request that one be appointed for him or her, and that this choice or request must be sent to the investigating judge’s office. It specifies that the indictment may only be issued following the person’s first appearance before the investigating judge.

The investigating judge may also have this summons served by a judicial police officer. This notification includes the information provided for in the previous paragraph; it is recorded in a report signed by the person who receives a copy.

The chosen or appointed lawyer is summoned under the conditions provided for by Article 114; he or she shall have access to the record of the proceedings under the conditions provided for by that article.

Le juge d’instruction peut informer une personne par lettre recommandée qu’elle est convoquée, dans un délai qui ne peut être inférieur à dix jours ni supérieur à deux mois, pour qu’il soit procédé à sa première comparution dans les conditions prévues par l’article 116. Cette lettre indique la date et l’heure de la convocation. Elle donne connaissance à la personne de chacun des faits dont ce magistrat est saisi et pour lesquels la mise en examen est envisagée, tout en précisant leur qualification juridique. Elle fait connaître à la personne qu’elle a le droit de choisir un avocat ou de demander qu’il lui en soit désigné un d’office, ce choix ou cette demande devant être adressé au greffe du juge d’instruction. Elle précise que la mise en examen ne pourra intervenir qu’à l’issue de la première comparution de la personne devant le juge d’instruction.

Le juge d’instruction peut également faire notifier cette convocation par un officier de police judiciaire. Cette notification comprend les mentions prévues à l’alinéa précédent ; elle est constatée par un procès-verbal signé par la personne qui en reçoit copie.

L’avocat choisi ou désigné est convoqué dans les conditions prévues par l’article 114 ; il a accès au dossier de la procédure dans les conditions prévues par cet article.
