Article 810-9 of the French Civil Code

Creditors who declare their claim after the account has been delivered may only claim against the remaining assets. In the event of insufficiency of these assets, they have recourse only against the legatees who have been fulfilled of their rights.

This recourse is time-barred after two years from the realisation of all the remaining assets.

Les créanciers qui déclarent leur créance postérieurement à la remise du compte ne peuvent prétendre qu’à l’actif subsistant. En cas d’insuffisance de cet actif, ils n’ont de recours que contre les légataires qui ont été remplis de leurs droits.

Ce recours se prescrit par deux ans à compter de la réalisation de la totalité de l’actif subsistant.
