Article 812-5 of the French Civil Code

Revocation on the grounds of the disappearance of a serious and legitimate interest does not give rise to the reimbursement by the agent of all or part of the sums received by way of remuneration, unless they have been excessive having regard to the duration or the responsibility actually assumed by the agent.

Without prejudice to damages, where the revocation is due to improper performance of his duties, the agent may be required to return all or part of the sums received by way of remuneration.

La révocation pour cause de disparition de l’intérêt sérieux et légitime ne donne pas lieu à la restitution par le mandataire de tout ou partie des sommes perçues au titre de sa rémunération, sauf si elles ont été excessives eu égard à la durée ou à la charge effectivement assumée par le mandataire.

Sans préjudice de dommages et intérêts, lorsque la révocation est intervenue en raison d’une mauvaise exécution de sa mission, le mandataire peut être tenu de restituer tout ou partie des sommes perçues au titre de sa rémunération.
