Article 812 of the French Code of Criminal Procedure

For the application of the provisions relating to police custody, when transport conditions do not allow the detained person to be brought before the competent magistrate, the criminal investigation police officer may order this person to report to him periodically, on condition that he immediately informs the competent magistrate. The latter will decide whether to release the detainee or to keep him or her in custody for a period that he or she determines, which may not extend beyond the day of the first air or sea connection.

Failing to comply with the obligation defined in the previous paragraph will be punishable by one year’s imprisonment and a fine of 15,000 euros.

Pour l’application des dispositions relatives à la garde à vue, lorsque les conditions de transport ne permettent pas de conduire devant le magistrat compétent la personne retenue, l’officier de police judiciaire peut prescrire à cette personne de se présenter à lui périodiquement, à charge d’en informer immédiatement le magistrat compétent. Ce dernier décide de la mainlevée de la mesure ou de son maintien pour une durée qu’il fixe et qui ne peut se prolonger au-delà du jour de la première liaison aérienne ou maritime.

Le fait de se soustraire à l’obligation définie au précédent alinéa est puni d’un an de prison et 15 000 euros d’amende.
