Article 813-1 of the French Civil Code

The judge may appoint any qualified person, natural or legal, as a mandatary of the succession, for the purpose of temporarily administering the succession due to the inertia, failure or fault of one or more heirs in this administration, their disagreement, a clash of interests between them or the complexity of the succession situation.

The application is made by an heir, a creditor, any person who, on behalf of the deceased, administered all or part of his estate during his lifetime, any other interested person or by the Public Prosecutor.

Article 813-1

Le juge peut désigner toute personne qualifiée, physique ou morale, en qualité de mandataire successoral, à l’effet d’administrer provisoirement la succession en raison de l’inertie, de la carence ou de la faute d’un ou de plusieurs héritiers dans cette administration, de leur mésentente, d’une opposition d’intérêts entre eux ou de la complexité de la situation successorale.

La demande est formée par un héritier, un créancier, toute personne qui assurait, pour le compte de la personne décédée, l’administration de tout ou partie de son patrimoine de son vivant, toute autre personne intéressée ou par le ministère public.
