Article 815-11 of the French Civil Code

Any undivided co-owner may claim his annual share of the profits, after deduction of the expenses incurred by the acts to which he has consented or which are enforceable against him.

In the absence of any other title, the extent of each person’s rights in the undivided co-ownership results from the act of notoriety or the inventory title drawn up by the notary.

In the event of a dispute, the president of the judicial court may order a provisional distribution of the profits subject to an account to be drawn up at the time of the final liquidation.

Up to the funds available, he may similarly order a capital advance on the undivided co-owner’s rights in the partition to be made.

Tout indivisaire peut demander sa part annuelle dans les bénéfices, déduction faite des dépenses entraînées par les actes auxquels il a consenti ou qui lui sont opposables.

A défaut d’autre titre, l’étendue des droits de chacun dans l’indivision résulte de l’acte de notoriété ou de l’intitulé d’inventaire établi par le notaire.

En cas de contestation, le président du tribunal judiciaire peut ordonner une répartition provisionnelle des bénéfices sous réserve d’un compte à établir lors de la liquidation définitive.

A concurrence des fonds disponibles, il peut semblablement ordonner une avance en capital sur les droits de l’indivisaire dans le partage à intervenir.
