Article 815-5-1 of the French Civil Code

Except in the event of dismemberment of ownership of the property or if one of the joint owners is in one of the cases provided for in article 836, the alienation of undivided property may be authorised by the court, at the request of one or more undivided co-owners holding at least two-thirds of the undivided rights, in accordance with the terms and conditions set out in the following paragraphs.

The undivided co-owner or co-owners holding at least two-thirds of the undivided rights shall express before a notary, by this majority, their intention to alienate the undivided property.

Within one month of its receipt, the notary shall serve notice of this intention on the other undivided co-owners.

If one or more of the undivided co-owners object to the alienation of the undivided property or do not come forward within three months of service, the notary shall record this in a report.

In this case, the court may authorise the disposal of the undivided property if it does not excessively prejudice the rights of the other undivided co-owners.

This disposal is carried out by auction. The sums withdrawn may not be reused except to pay the debts and charges of the undivided co-ownership.

The alienation carried out under the conditions set by the authorisation of the judicial court may be set up against the undivided co-owner whose consent was lacking, unless the intention to alienate the property of the undivided co-owner or co-owners holding at least two-thirds of the undivided rights had not been notified to him or them in the manner set out in the third paragraph.

Sauf en cas de démembrement de la propriété du bien ou si l’un des indivisaires se trouve dans l’un des cas prévus à l’article 836, l’aliénation d’un bien indivis peut être autorisée par le tribunal judiciaire, à la demande de l’un ou des indivisaires titulaires d’au moins deux tiers des droits indivis, suivant les conditions et modalités définies aux alinéas suivants.

Le ou les indivisaires titulaires d’au moins deux tiers des droits indivis expriment devant un notaire, à cette majorité, leur intention de procéder à l’aliénation du bien indivis.

Dans le délai d’un mois suivant son recueil, le notaire fait signifier cette intention aux autres indivisaires.

Si l’un ou plusieurs des indivisaires s’opposent à l’aliénation du bien indivis ou ne se manifestent pas dans un délai de trois mois à compter de la signification, le notaire le constate par procès-verbal.

Dans ce cas, le tribunal judiciaire peut autoriser l’aliénation du bien indivis si celle-ci ne porte pas une atteinte excessive aux droits des autres indivisaires.

Cette aliénation s’effectue par licitation. Les sommes qui en sont retirées ne peuvent faire l’objet d’un remploi sauf pour payer les dettes et charges de l’indivision.

L’aliénation effectuée dans les conditions fixées par l’autorisation du tribunal judiciaire est opposable à l’indivisaire dont le consentement a fait défaut, sauf si l’intention d’aliéner le bien du ou des indivisaires titulaires d’au moins deux tiers des droits indivis ne lui avait pas été signifiée selon les modalités prévues au troisième alinéa.
