Article 817 of the French Civil Code

A person who is undivided as to enjoyment may request the division of the undivided usufruct by way of segregation on a property or, if this is not possible, by way of licitation of the usufruct. Where this appears to be the only way of protecting the interests of all the holders of rights in the undivided property, the licitation may relate to the full ownership.

Celui qui est en indivision pour la jouissance peut demander le partage de l’usufruit indivis par voie de cantonnement sur un bien ou, en cas d’impossibilité, par voie de licitation de l’usufruit. Lorsqu’elle apparaît seule protectrice de l’intérêt de tous les titulaires de droits sur le bien indivis, la licitation peut porter sur la pleine propriété.
