Article 829 of the French Code of civil procedure

When made during the course of proceedings, the declaration by which each of the parties consents to the proceedings being conducted without a hearing shall be delivered or sent to the court registry and shall include, on pain of nullity:

1° For natural persons: an indication of the surname, first names, profession, place of residence, nationality, date and place of birth;

For legal persons: an indication of the name, first names, profession, place of residence, nationality, date and place of birth
2° For legal entities: an indication of their legal form, name, registered office and the body that legally represents them;

It must be written, dated and signed by the applicant.

Lorsqu’elle est formulée en cours d’instance, la déclaration par laquelle chacune des parties consent au déroulement de la procédure sans audience est remise ou adressée au greffe et comporte à peine de nullité :


1° Pour les personnes physiques : l’indication des nom, prénoms, profession, domicile, nationalité, date et lieu de naissance ;


2° Pour les personnes morales : l’indication de leur forme, leur dénomination, leur siège social et de l’organe qui les représente légalement ;


Elle est écrite, datée et signée de la main de son auteur. Celui-ci doit lui annexer, en original ou en photocopie, tout document officiel justifiant de son identité et comportant sa signature.
