Article 831-1 of the French Civil Code

In the event that neither the surviving spouse nor any co-owner heir requests the application of the provisions set out in article 831 or those of articles 832 or 832-1, the preferential allotment provided for in agricultural matters may be granted to any co-partitioner on condition that he undertakes to lease the property in question within a period of six months under the conditions set out in Chapter VI of Title I of Book IV of the Rural and Maritime Fishing Code to one or more of the co-heirs meeting the personal conditions set out in Article 831 or to one or more descendants of these co-heirs meeting these same conditions.

The preferential allotment provided for in agricultural matters may be granted to any co-partitioner on condition that he undertakes to lease the property in question within a period of six months under the conditions set out in Chapter VI of Title I of Book IV of the Rural and Maritime Fishing Code.

Au cas où ni le conjoint survivant, ni aucun héritier copropriétaire ne demande l’application des dispositions prévues à l’article 831 ou de celles des articles 832 ou 832-1, l’attribution préférentielle prévue en matière agricole peut être accordée à tout copartageant sous la condition qu’il s’oblige à donner à bail dans un délai de six mois le bien considéré dans les conditions fixées au chapitre VI du titre Ier du livre IV du code rural et de la pêche maritime à un ou plusieurs des cohéritiers remplissant les conditions personnelles prévues à l’article 831 ou à un ou plusieurs descendants de ces cohéritiers remplissant ces mêmes conditions.
