Article 831-2 of the French Civil Code

The surviving spouse or any co-owner heir may also apply for preferential allotment:

1° Of the ownership or the right to the lease of the premises which effectively serve as his or her dwelling, if he or she had his or her residence there at the time of the death, and of the furniture furnishing it, as well as of the deceased’s vehicle provided that this vehicle is necessary for him or her for the needs of everyday life ;

2° Of the ownership or the right to the lease of the premises for professional use actually used for the exercise of his profession and the movable items necessary for the exercise of his profession;

3° Of all the movable items necessary for the exploitation of a rural property cultivated by the deceased as a farmer or sharecropper where the lease continues in favour of the claimant or where a new lease is granted to the claimant.

Le conjoint survivant ou tout héritier copropriétaire peut également demander l’attribution préférentielle :

1° De la propriété ou du droit au bail du local qui lui sert effectivement d’habitation, s’il y avait sa résidence à l’époque du décès, et du mobilier le garnissant, ainsi que du véhicule du défunt dès lors que ce véhicule lui est nécessaire pour les besoins de la vie courante ;

2° De la propriété ou du droit au bail du local à usage professionnel servant effectivement à l’exercice de sa profession et des objets mobiliers nécessaires à l’exercice de sa profession ;

3° De l’ensemble des éléments mobiliers nécessaires à l’exploitation d’un bien rural cultivé par le défunt à titre de fermier ou de métayer lorsque le bail continue au profit du demandeur ou lorsqu’un nouveau bail est consenti à ce dernier.
