Article 841-1 of the French Civil Code

If the notary appointed to draw up the liquidation statement comes up against the inertia of an undivided co-owner, he may give him formal notice, by extrajudicial act, to be represented.

If the undivided co-owner fails to appoint a proxy within three months of the formal notice, the notary may ask the judge to appoint any qualified person to represent the defaulter until the operations have been completed.

Si le notaire commis pour établir l’état liquidatif se heurte à l’inertie d’un indivisaire, il peut le mettre en demeure, par acte extrajudiciaire, de se faire représenter.

Faute pour l’indivisaire d’avoir constitué mandataire dans les trois mois de la mise en demeure, le notaire peut demander au juge de désigner toute personne qualifiée qui représentera le défaillant jusqu’à la réalisation complète des opérations.
