Article 841 of the French Civil Code

The court of the place where the succession was opened has exclusive jurisdiction to hear actions for partition and disputes that arise either when the indivision is maintained or during the partition operations. It orders the auctioning of property and rules on claims relating to the security of lots between the co-sharers and on claims for the nullity of the partition or for additional shares.

Le tribunal du lieu d’ouverture de la succession est exclusivement compétent pour connaître de l’action en partage et des contestations qui s’élèvent soit à l’occasion du maintien de l’indivision soit au cours des opérations de partage. Il ordonne les licitations et statue sur les demandes relatives à la garantie des lots entre les copartageants et sur celles en nullité de partage ou en complément de part.
