Article 850 of the French Code of Criminal Procedure

The first paragraph of Article 529 reads as follows:

“For contraventions of locally applicable regulations on road traffic, insurance, hunting, fishing, environmental protection, consumer law, safety at sea, regulations on pubs or manifest public drunkenness and ecobuage, which are punishable only by a fine, the public prosecution is extinguished by the payment of a fixed fine which is exclusive of the application of the rules on repeat offences. “

In New Caledonia, for contraventions of locally applicable land transport regulations that are only punishable by a fine, public action is extinguished by the payment of a fixed fine that is exclusive of the application of the rules of recidivism.

” Pour les contraventions aux réglementations applicables localement en matière de circulation routière, d’assurances, de chasse, de pêche, de protection de l’environnement, de droit de la consommation, de la sécurité en mer, de réglementation sur les débits de boissons ou l’ivresse publique manifeste et d’écobuage, qui sont punies seulement d’une peine d’amende, l’action publique est éteinte par le paiement d’une amende forfaitaire qui est exclusive de l’application des règles de la récidive. ”
