Article 86 of the French Code of civil procedure

The court shall refer the case to the court which it considers to have jurisdiction. This decision shall be binding on the parties and on the referring court.

Where the referral is made to the court which was originally seised, the proceedings shall continue at the behest of the court.

La cour renvoie l’affaire à la juridiction qu’elle estime compétente. Cette décision s’impose aux parties et au juge de renvoi.

Lorsque le renvoi est fait à la juridiction qui avait été initialement saisie, l’instance se poursuit à la diligence du juge.
