Article 880 of the French Code of Criminal Procedure

Where the movement of a lawyer or a person approved pursuant to article 879 appears materially impossible, the powers vested in the lawyer by the articles 63-4 to 63-4-3 may be exercised by a person chosen by the person in police custody, who is not implicated for the same acts or for related acts and who has not been the subject of any conviction, incapacity or disqualification mentioned in bulletin no. 2 of the criminal record. The provisions of article 63-4-4 are applicable to the person chosen, who is informed of this by the judicial police officer.

Without prejudice to the application of Article 434-7-2 of the Criminal Code, it is an offence for a person, who has been called to intervene under the conditions provided for in the previous paragraph, report to anyone the interview, the hearings or the content of the minutes consulted with the aim of obstructing the course of justice is punishable by one year’s imprisonment and a fine of €15,000.

This article applies to the assistance by a lawyer provided for in 5° of article 61-1.

Lorsque le déplacement d’un avocat ou d’une personne agréée en application de l’article 879 paraît matériellement impossible, les attributions dévolues à l’avocat par les articles 63-4 à 63-4-3 peuvent être exercées par une personne choisie par la personne gardée à vue, qui n’est pas mise en cause pour les mêmes faits ou pour des faits connexes et qui n’a fait l’objet d’aucune condamnation, incapacité ou déchéance mentionnée au bulletin n° 2 du casier judiciaire. Les dispositions de l’article 63-4-4 sont applicables à la personne choisie, qui en est informée par l’officier de police judiciaire.

Sans préjudice de l’application de l’article 434-7-2 du code pénal, le fait pour une personne, qui a été appelée à intervenir dans les conditions prévues à l’alinéa précédent, de faire état auprès de quiconque de l’entretien, des auditions ou du contenu des procès-verbaux consultés dans le but d’entraver le cours de la justice est puni d’un an d’emprisonnement et de 15 000 € d’amende.

Le présent article est applicable à l’assistance par un avocat prévue au 5° de l’article 61-1.
