Article 887 of the French Civil Code

The partition may be annulled on the grounds of violence or fraud.

It may also be annulled on the grounds of error, if the error concerned the existence or the proportion of the rights of the co-sharers or the ownership of the property included in the partitionable mass.

If it appears that the consequences of violence, fraud or error can be remedied other than by annulling the partition, the court may, at the request of one of the parties, order a supplementary or rectifying partition.

Le partage peut être annulé pour cause de violence ou de dol.

Il peut aussi être annulé pour cause d’erreur, si celle-ci a porté sur l’existence ou la quotité des droits des copartageants ou sur la propriété des biens compris dans la masse partageable.

S’il apparaît que les conséquences de la violence, du dol ou de l’erreur peuvent être réparées autrement que par l’annulation du partage, le tribunal peut, à la demande de l’une des parties, ordonner un partage complémentaire ou rectificatif.
