Article 889 of the French Civil Code

Where one of the co-partitioners establishes that he has suffered an injury of more than one quarter, the supplement to his share shall be provided, at the option of the defendant, either in cash or in kind. In order to assess whether there has been a lesion, the objects are estimated according to their value at the time of the partition.

The action for the supplement of a share is time-barred after two years from the date of the partition.

Lorsque l’un des copartageants établit avoir subi une lésion de plus du quart, le complément de sa part lui est fourni, au choix du défendeur, soit en numéraire, soit en nature. Pour apprécier s’il y a eu lésion, on estime les objets suivant leur valeur à l’époque du partage.

L’action en complément de part se prescrit par deux ans à compter du partage.
