Article 890 of the French Civil Code

An action in complement of share is admitted against any act, whatever its denomination, the object of which is to put an end to indivision between co-partitioners.

The action is no longer admitted where a settlement has been reached following the partition or the act in lieu thereof on the difficulties presented by that partition or that act.

In the case of successive partial divisions, lesion is assessed without taking into account either the partial division that has already taken place where this has fulfilled the parties’ rights in equal shares or the property not yet divided.

L’action en complément de part est admise contre tout acte, quelle que soit sa dénomination, dont l’objet est de faire cesser l’indivision entre copartageants.

L’action n’est plus admise lorsqu’une transaction est intervenue à la suite du partage ou de l’acte qui en tient lieu sur les difficultés que présentait ce partage ou cet acte.

En cas de partages partiels successifs, la lésion s’apprécie sans tenir compte ni du partage partiel déjà intervenu lorsque celui-ci a rempli les parties de leurs droits par parts égales ni des biens non encore partagés.
