Article 90 of the French Code of civil procedure

Where the court has declared itself to have jurisdiction and has ruled on the merits of the dispute in the same judgment given at first instance, that judgment may be appealed against in its entirety.

Where the court reverses on the ground of jurisdiction, it shall nevertheless rule on the merits of the dispute if the court is a court of appeal in relation to the court which it considers to have jurisdiction.

If it is not a court of appeal, the court, in reversing the contested decision on the ground of jurisdiction, remits the case to the court which is a court of appeal in relation to the court which would have had jurisdiction at first instance. This decision is binding on the parties and on the referring court.

Article 90

Lorsque le juge s’est déclaré compétent et a statué sur le fond du litige dans un même jugement rendu en premier ressort, celui-ci peut être frappé d’appel dans l’ensemble de ses dispositions.

Lorsque la cour infirme du chef de la compétence, elle statue néanmoins sur le fond du litige si la cour est juridiction d’appel relativement à la juridiction qu’elle estime compétente.

Si elle n’est pas juridiction d’appel, la cour, en infirmant du chef de la compétence la décision attaquée, renvoie l’affaire devant la cour qui est juridiction d’appel relativement à la juridiction qui eût été compétente en première instance. Cette décision s’impose aux parties et à la cour de renvoi.
