Article 91 of the French Code of civil procedure

Where the court has declared that it has jurisdiction and has ruled on the merits of the dispute in the same judgment given at last instance, the judgment may be appealed against solely on the question of jurisdiction. An appeal lodged against the provisions on the merits of the case renders the appeal inadmissible.
In the event of an appeal, where the court reverses the contested decision on the ground of jurisdiction, it refers the case back to the court that it considers to have jurisdiction, to which the case file is sent on expiry of the time limit for lodging an appeal or, where applicable, when the appeal has been decided. The referral decision is binding on the parties and on the referring court.

Lorsque le juge s’est déclaré compétent et a statué sur le fond du litige dans un même jugement rendu en dernier ressort, celui-ci peut être frappé d’appel exclusivement sur la compétence. Un pourvoi formé à l’encontre des dispositions sur le fond rend l’appel irrecevable.

En cas d’appel, lorsque la cour infirme la décision attaquée du chef de la compétence, elle renvoie l’affaire devant la juridiction qu’elle estime compétente à laquelle le dossier est transmis à l’expiration du délai du pourvoi ou, le cas échéant, lorsqu’il a été statué sur celui-ci. La décision de renvoi s’impose aux parties et à la juridiction de renvoi.
