Article 916-3 of the French Cinema and Moving Image Code

In order to boost the production and preparation of cinematographic works, direct allocations are granted to delegated production companies in addition to the sums they invest, pursuant to articles 211-41, 211-62, 211-67 and 411-11, for applications submitted between 1 October 2020 and 30 April 2021 and also between 1 May 2021 and 31 October 2021 for sums invested for production, when the following conditions are met:
1° The cinematographic works are French-initiated;
2° With regard to the sums invested for production, the cinematographic works have been the subject of an application for investment approval between 1 May 2020 and 30 April 2021 or between 1 May 2021 and 31 October 2021. In the latter case, shooting or animation production must begin before 30 November 2021.
The amount of the direct allocation is equal to 25% of the amount of the sums invested, up to a limit of €100,000 per company for sums invested in preparation and €300,000 per company for sums invested in production for applications submitted between 1 May 2021 and 31 October 2021.
The allocation of direct grants is subject to the provisions of Commission Regulation (EU) No 651/2014 of 17 June 2014 declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 of the Treaty, in particular those provided for in Chapter I and Article 54 of Section 11 relating to aid schemes for audiovisual works.

Afin de relancer la production et la préparation d’œuvres cinématographiques, des allocations directes sont attribuées aux entreprises de production déléguées en complément des sommes qu’elles investissent, en application des articles 211-41, 211-62, 211-67 et 411-11, au titre des demandes présentées entre le 1er octobre 2020 et le 30 avril 2021 et également entre le 1er mai 2021 et le 31 octobre 2021 en ce qui concerne les sommes investies pour la production, lorsque les conditions suivantes sont remplies :
1° Les œuvres cinématographiques sont d’initiative française ;
2° En ce qui concerne les sommes investies pour la production, les œuvres cinématographiques ont fait l’objet d’une demande d’agrément des investissements entre le 1er mai 2020 et le 30 avril 2021 ou entre le 1er mai 2021 et le 31 octobre 2021. Dans ce dernier cas, les prises de vues ou la fabrication de l’animation débutent avant le 30 novembre 2021.
Le montant de l’allocation directe est égal à 25 % du montant des sommes investies, dans la limite de 100 000 € par entreprise en ce qui concerne les sommes investies pour la préparation et de 300 000 € par entreprise en ce qui concerne les sommes investies pour la production au titre des demandes présentées entre le 1er mai 2021 et le 31 octobre 2021.
L’attribution des allocations directes est soumise aux dispositions du règlement (UE) n° 651/2014 de la Commission du 17 juin 2014 déclarant certaines catégories d’aides compatibles avec le marché intérieur en application des articles 107 et 108 du traité, notamment celles prévues par le chapitre Ier et l’article 54 de la section 11 relatif aux régimes d’aides en faveur des œuvres audiovisuelles.
