Article 935 of the French Civil Code

A gift made to an unemancipated minor or an adult under guardianship must be accepted by his or her guardian, in accordance with article 463, under the heading “Of minority, guardianship and emancipation”.

However, the father and mother of the unemancipated minor, or other ascendants, even during the lifetime of the father and mother, even though they are not the minor’s guardians, may accept for him or her.

La donation faite à un mineur non émancipé ou à un majeur en tutelle devra être acceptée par son tuteur, conformément à l’article 463, au titre ” De la minorité, de la tutelle et de l’émancipation “.

Néanmoins, les père et mère du mineur non émancipé, ou les autres ascendants, même du vivant des père et mère, quoiqu’ils ne soient pas tuteurs du mineur, pourront accepter pour lui.
