Article 99 of the French Civil Code

The rectification of civil status records is ordered by the president of the court.

The rectification of the indication of sex and, where applicable, first names is ordered at the request of any person with a variation in genital development or, if he or she is a minor, at the request of his or her legal representatives, if it is medically established that his or her sex does not correspond to that shown on his or her birth record.

The annulment of civil status records is ordered by the court. However, the public prosecutor with territorial jurisdiction may have the record annulled where it has been irregularly drawn up.

La rectification des actes de l’état civil est ordonnée par le président du tribunal.

La rectification de l’indication du sexe et, le cas échéant, des prénoms est ordonnée à la demande de toute personne présentant une variation du développement génital ou, si elle est mineure, à la demande de ses représentants légaux, s’il est médicalement constaté que son sexe ne correspond pas à celui figurant sur son acte de naissance.

L’annulation des actes de l’état civil est ordonnée par le tribunal. Toutefois, le procureur de la République territorialement compétent peut faire procéder à l’annulation de l’acte lorsque celui-ci est irrégulièrement dressé.
