Article A123-4 of the French Commercial code

The period of interruption of service at the end of which the declarant is authorised by the single body to transmit the single dossier mentioned in article R. 123-3 to the recipient bodies or, where applicable, to the authorities authorised to issue authorisations, is set at five days.

This possibility is only authorised in the event that a recipient body or, where applicable, an authority authorised to issue authorisations, is unable to receive all or part of the single dossier defined in article R. 123-3 from the single body. The declarant then forwards the single dossier to them, according to their own procedures. The recipient body or the authorised authority acknowledges receipt and, once informed that the technical incident has been resolved, proceeds to regularise the situation under the same conditions as those provided for in article R. 123-7.

La durée d’interruption de service à l’issue de laquelle le déclarant est autorisé par l’organisme unique à transmettre le dossier unique mentionné à l’article R. 123-3 aux organismes destinataires ou, le cas échéant, aux autorités habilitées à délivrer les autorisations, est fixée à cinq jours.

Cette possibilité n’est autorisée que dans le cas où un organisme destinataire ou, le cas échéant, une autorité habilitée à délivrer les autorisations, se trouve dans l’incapacité de recevoir de l’organisme unique, tout ou partie du dossier unique défini à l’article R. 123-3. Le déclarant leur transmet alors le dossier unique, selon des modalités qui leur sont propres. L’organisme destinataire ou l’autorité habilitée en accuse réception et, une fois informé de la résolution de l’incident technique, procède à la régularisation de la situation dans les mêmes conditions que celles prévues à l’article R. 123-7.
