Article A444-200 of the French Commercial code

The acts and formalities carried out in relation to incidents (number 48 of table 6) give rise to the following fees:

1° If the incident is in the nature of a principal claim, the lawyer shall receive the fee set out in article A. 444-194;

2° If the incident is not in the nature of a principal claim and gives rise to a judgment terminating the proceedings, the lawyer shall receive half the fee set in 1° of Article A. 444-194.

Les actes et formalités réalisés en matière d’incidents (numéro 48 du tableau 6) donnent lieu aux émoluments suivants :

1° Si l’incident présente le caractère d’une demande principale, l’avocat perçoit l’émolument fixé à l’article A. 444-194 ;

2° Si l’incident n’a pas le caractère d’une demande principale et donne lieu à un jugement mettant fin à la procédure, l’avocat perçoit la moitié de l’émolument fixé au 1° de l’article A. 444-194.
