Article A811-31 of the French Commercial code

I.-Applications from the persons referred to in article R. 811-27 shall be sent to the secretariat of the Commission nationale d’inscription et de discipline des administrateurs judiciaires et des mandataires judiciaires, by registered letter, with acknowledgement of receipt or by any other means that ensures receipt or allows the date to be determined, no later than three months before the date of the first test of the session.

II – The file will include:

>A request from the interested party
1° a request from the person concerned;

> and
2° Copies of official documents proving the identity and nationality of the applicant;

3° Proof of the applicant’s place of residence;

4° Copies of the diplomas, certificates, titles and attestations referred to in article R. 811-27;

5° All documents enabling an assessment to be made as to whether the applicant meets the conditions laid down in articles L. 811-5 and R. 811-27, as well as details of the training or course of study followed and the initial and continuing vocational training received;

6° A document from the competent authority in his home country certifying that he has not been convicted of any of the offences or penalties mentioned in 2° to 4° of article L. 811-5 in the profession that he/she previously exercised, or a certificate dated less than three months ago issued by the competent judicial or administrative authority and, where applicable, by a notary or a professional body, stating that the person concerned has declared on oath or solemnly, if no such oath exists in that State, that he/she has not been subject to any such convictions or sanctions.
Where applicable, the supporting documents, except those relating to the identity and nationality of the applicant, must be accompanied by a French translation. With the exception of the documents mentioned in 2° and 5°, this translation shall be carried out by a translator registered on the national list of legal experts or on one of the lists of legal experts drawn up by the Courts of Appeal or by a translator authorised to intervene before the judicial or administrative authorities of another Member State of the European Union or of a State party to the Agreement on the European Economic Area.

I.-Les demandes des personnes mentionnées à l’article R. 811-27 sont adressées au secrétariat de la Commission nationale d’inscription et de discipline des administrateurs judiciaires et des mandataires judiciaires, par lettre recommandée, avec demande d’avis de réception ou tout autre moyen permettant d’en assurer la réception ou d’en déterminer la date au plus tard trois mois avant la date de la première épreuve de la session.

II.-Le dossier comprend :

1° Une requête de l’intéressé ;

2° La copie des documents officiels justifiant de l’identité et de la nationalité du requérant ;

3° Un justificatif du domicile du demandeur ;

4° La copie des diplômes, certificats, titres, attestations visés à l’article R. 811-27 ;

5° Tous documents permettant d’apprécier si le demandeur remplit les conditions prévues par les articles L. 811-5 et R. 811-27 ainsi que le contenu détaillé de la formation ou cycle d’études suivi et de la formation professionnelle initiale et continue reçue ;

6° Un document de l’autorité compétente de son Etat d’origine attestant qu’il n’a pas fait l’objet des condamnations ou sanctions mentionnées aux 2° à 4° de l’article L. 811-5 dans la profession qu’il exerçait antérieurement, ou une attestation datant de moins de trois mois délivrée par l’autorité judiciaire ou administrative compétente et, le cas échéant, par un notaire ou un organisme professionnel, établissant que l’intéressé a déclaré sous serment ou solennellement, si un tel serment n’existe pas dans cet Etat, qu’il n’a pas fait l’objet de telles condamnations ou sanctions.

Le cas échéant, les pièces justificatives, sauf celles relatives à l’identité et à la nationalité du demandeur, doivent être accompagnées de leur traduction en langue française. A l’exception des documents mentionnés au 2° et au 5°, cette traduction est effectuée par un traducteur inscrit sur la liste nationale des experts judiciaires ou sur l’une des listes d’experts judiciaires dressées par les cours d’appel ou par un traducteur habilité à intervenir auprès des autorités judiciaires ou administratives d’un autre Etat membre de l’Union européenne ou d’un Etat partie à l’accord sur l’Espace économique européen.
