The knowledge-testing examination consists of the following tests:

1° A written test, lasting five hours, the purpose of which is to deal with a case file relating to one or more of the tasks likely to be entrusted to a judicial administrator.

The mark is assigned a coefficient of 2.
The mark is weighted at 2.

> An oral examination consisting of a question and answer session.
2° An oral examination consisting of a thirty-minute question on professional ethics, the regulations governing the profession and the management of a law firm.

3° An oral examination consisting of a thirty-minute question on one or more of the following subjects, including the subject or subjects on this same list referred to in the Commission’s decision, where applicable, pursuant to article R. 811-29:

-National law relating to companies in difficulty;

-European and international law relating to companies in difficulty;

-Employment law related to insolvency proceedings;

-Tax law related to insolvency proceedings;

-Accounting corresponding to the DSCG exam programme;

Financial management and management control corresponding to the DSCG exam programme;

Financial management and management control corresponding to the DSCG exam programme
-Financial management and management control corresponding to the syllabus for the DSCG exam;

Contract law
-Contract law;

-Securities law;

> Company and group law;

Company law
-Company and group law;

Criminal business law;

Company law
-Business criminal law;

-Civil procedure;

-Law of civil enforcement procedures.

The mark is subject to a coefficient of 1.

The subjects of the tests are decided and composed by the jury.

Article A811-34

L’examen de contrôle des connaissances se compose des épreuves suivantes :

1° Une épreuve écrite, d’une durée de cinq heures, ayant pour objet le traitement d’un dossier portant sur une ou plusieurs des missions susceptibles d’être confiées à un administrateur judiciaire.

La note est affectée d’un coefficient 2.

2° Un oral consistant en une interrogation d’une durée de trente minutes portant sur la déontologie, la réglementation de la profession et la gestion d’une étude.

La note est affectée d’un coefficient 1.

3° Un oral consistant en une interrogation d’une durée de trente minutes portant sur une ou plusieurs des matières suivantes, dont la ou les matières de cette même liste visées par la décision de la Commission, le cas échéant, en application de l’article R. 811-29 :

-Droit national des entreprises en difficulté ;

-Droit européen et international des entreprises en difficulté ;

-Droit social lié aux procédures collectives ;

-Droit fiscal lié aux procédures collectives ;

-Comptabilité correspondant au programme de l’épreuve du DSCG ;

-Gestion financière et contrôle de gestion correspondant au programme de l’épreuve du DSCG ;

-Droit des contrats ;

-Droit des sûretés ;

-Droit des sociétés et des groupements ;

-Droit pénal des affaires ;

-Procédure civile ;

-Droit des procédures civiles d’exécution.

La note est affectée d’un coefficient 1.

Les sujets des épreuves sont arrêtés et composés par le jury.
