Declare that I am aware of the provisions of Article L. 321-4 of the French Commercial Code, as amended by Law No. 2011-850 of 20 July 2011 on the liberalisation of voluntary sales of furniture by public auction, under the terms of which:

“Only operators meeting the conditions defined in this article may organise and carry out voluntary sales of furniture by public auction and electronic auctions.

I.-If it is a natural person, the operator of voluntary sales of movable property by public auction must:

1° Be French or a national of a Member State of the European Union or another State party to the Agreement on the European Economic Area;

2° Not have been the perpetrator of acts that have resulted in a final criminal conviction for acts contrary to honour, probity or morality or acts of the same nature that have resulted in a disciplinary or administrative sanction of dismissal, striking off, revocation, withdrawal of approval or authorisation in the profession in which they previously exercised ;

3° Have the qualification required to manage a sale or hold a title, diploma or authorisation recognised as equivalent in this area;

4° Have previously declared their activity to the Conseil des maisons de vente instituted by article L. 321-18 “.

Certify on my honour that I have not been the perpetrator of any acts that have given rise to a final criminal conviction for acts contrary to honour, probity or morality or acts of the same nature that have given rise to a disciplinary or administrative sanction of dismissal, striking off, revocation, withdrawal of approval or authorisation in the profession that I previously practised, where applicable.

Déclare prendre connaissance des dispositions de l’article L. 321-4 du code de commerce, modifié par la loi n° 2011-850 du 20 juillet 2011 de libéralisation des ventes volontaires de meubles aux enchères publiques, aux termes desquelles :

” Seuls peuvent organiser et réaliser des ventes volontaires de meubles aux enchères publiques et des ventes aux enchères par voie électronique les opérateurs remplissant les conditions définies au présent article.

I.-S’il s’agit d’une personne physique, l’opérateur de ventes volontaires de meubles aux enchères publiques doit :

1° Etre français ou ressortissant d’un Etat membre de l’Union européenne ou d’un autre Etat partie à l’accord sur l’Espace économique européen ;

2° N’avoir pas été l’auteur de faits ayant donné lieu à une condamnation pénale définitive pour des agissements contraires à l’honneur, à la probité ou aux bonnes mœurs ou de faits de même nature ayant donné lieu à une sanction disciplinaire ou administrative de destitution, radiation, révocation, de retrait d’agrément ou d’autorisation dans la profession qu’il exerçait antérieurement ;

3° Avoir la qualification requise pour diriger une vente ou être titulaire d’un titre, d’un diplôme ou d’une habilitation reconnus équivalents en la matière ;

4° Avoir préalablement déclaré son activité auprès du Conseil des maisons de vente institué par l’article L. 321-18 “.

Certifie sur l’honneur n’avoir pas été l’auteur de faits ayant donné lieu à une condamnation pénale définitive pour des agissements contraires à l’honneur, à la probité ou aux bonnes mœurs ou de faits de même nature ayant donné lieu à une sanction disciplinaire ou administrative de destitution, radiation, révocation, de retrait d’agrément ou d’autorisation dans la profession que j’exerçais, le cas échéant, antérieurement.
