Article ANNEXE, art. 30-11 of the French Code of civil procedure

For the application of article 73 of the local civil code, before making an order for the withdrawal of the association’s legal capacity, the court takes the observations of the management or requests them by registered letter with acknowledgement of receipt and seeks the opinion of the public prosecutor’s office on the file thus completed.

The court sets the case down for a hearing, the date of which it fixes and of which it informs the public prosecutor’s office. The members of the management are convened to the hearing at least fifteen days in advance by the clerk of the district court.

The case is heard and judged in chambers.

Pour l’application de l’article 73 du code civil local, avant de prendre une ordonnance de retrait de la capacité juridique de l’association, le tribunal recueille les observations de la direction ou les lui demande par lettre recommandée avec demande d’avis de réception et sollicite l’avis du ministère public sur le dossier ainsi complété.

Le tribunal inscrit l’affaire à une audience dont il fixe la date et dont il informe le ministère public. Les membres de la direction y sont convoqués quinze jours au moins à l’avance par le greffier du tribunal d’instance.

L’affaire est instruite et jugée en chambre du conseil.
