Article D1142-3 of the French Public Health Code

The medical expert called upon to assess the incapacity of the victim of an injury to which the scale does not include a reference informs, in a reasoned opinion, the competent Commission for Conciliation and Compensation of Medical Accidents, Iatrogenic Affections and Nosocomial Infections of the references on the basis of which he carries out this assessment.

This information is sent to the National Commission for Medical Accidents as well as to the interested parties and, where applicable, their insurers.

The commission referred to in the first paragraph sets a degree of incapacity on the basis of this assessment.

L’expert médical appelé à évaluer l’incapacité de la victime d’une lésion à laquelle le barème ne comporte pas de référence informe, par avis motivé, la commission de conciliation et d’indemnisation des accidents médicaux, des affections iatrogènes et des infections nosocomiales compétente des références à l’aide desquelles il procède à cette évaluation.

Cette information est transmise à la Commission nationale des accidents médicaux ainsi qu’aux parties intéressées et, le cas échéant, à leurs assureurs.

La commission mentionnée au premier alinéa fixe un taux d’incapacité sur la base de cette évaluation.
